Terms and Conditions - Tu Voto Decide

1. Introduction

These Terms and Conditions (hereinafter, "T&C") regulate the use of the mobile application "Tu Voto Decide", developed and managed by Consultora Blockchain S.R.L. By downloading, installing, or using the application, the user expressly accepts these T&C.

2. Purpose

"Tu Voto Decide" is a decentralized application designed exclusively to facilitate electoral oversight through technologies based on Account Abstraction (ERC-4337), operating without custody of funds, keys, or data by the provider. It integrates Wira Wallet technology for the issuance of sovereign digital identities and the use of human oracles for collective and transparent verifications. It allows:

• Issuing and managing decentralized credentials (VC) linked to a sovereign identity to participate in electoral monitoring processes.
• Conducting on-chain electoral verifications and reports without the need to directly handle gas fees, ensuring transparency and anonymity.
• Executing interactions between different blockchain networks (Network Abstraction) to record electoral observations immutably.
• Configuring and managing account recovery mechanisms through on-chain guardians, adapted to maintain integrity in electoral contexts.
• Using human oracles (decentralized verified users) to collectively validate electoral data without revealing personal information.

The main objective is to promote transparency and citizen oversight in electoral processes, ensuring all operations are conducted in a sovereign and verifiable manner.

3. Usage License

Consultora Blockchain S.R.L. grants the user a limited, revocable, non-exclusive, and non-transferable license to install and use "Tu Voto Decide" on a personal device. Copying, modifying, distributing, decompiling, or using the application for purposes other than the described electoral oversight is prohibited.

4. Registration and Security

To use the app, the user must register their sovereign identity by capturing photographs of their DNI and a selfie, processed locally for biometric verification. Subsequently, they configure a personal PIN and can enable biometric authentication. The PIN, private keys, and any electoral data are not stored by the backend nor can be recovered by the company, guaranteeing user sovereignty in the electoral context.

5. Storage and Custody

Credentials, keys, and data related to electoral verifications are stored encrypted on the user's device. "Tu Voto Decide" does not operate as a custody service, meaning neither Consultora Blockchain S.R.L. nor any third party can access their assets, personal data, or perform transactions or verifications on their behalf. Human oracles only interact with anonymized data and hashes on the blockchain.

6. Transactions and Gas Abstraction

Electoral verifications and reports generated by the user are processed through a system of relayers and EntryPoint following the ERC-4337 standard, which enables gas abstraction. The user only needs to approve the operation from their device, and the gas is automatically deducted from the smart account balance, facilitating participation in electoral oversight without technical barriers.

7. Account Recovery and Guardians

The user can define on-chain guardians that will serve as backup in case of PIN loss, ensuring continuity in electoral participation. The recovery mechanism is based on smart contracts and requires the minimum approval configured by the user.

Disclaimer: The company is not responsible for loss of access due to poor management or selection of guardians by the user, nor for any impact on the ability to conduct electoral oversight.

8. Liability and Disclaimer

The application is provided "as is", without warranties of continuous availability or absence of errors. Consultora Blockchain S.R.L. shall not be liable for losses arising from misuse of the App, network failures, blockchain attacks, external electoral manipulations, or fluctuations in decentralized networks. The App does not provide electoral, legal, or financial advice, and the user assumes full responsibility for their verifications and reports.

Additionally, the company does not guarantee the accuracy of validations performed through human oracles, as they depend on decentralized collective participation.

9. Privacy

"Tu Voto Decide" collects and uses data exclusively for the purposes detailed in the Privacy Policy, aligned with electoral oversight. No sensitive content analysis is performed, and all information remains encrypted, including credentials, documents, biometric proofs, and electoral verification data.

10. Applicable Legislation

These Terms are governed by Bolivian legislation, including:

• Law N° 1082 on Digital Citizenship.
• Law N° 164 on Telecommunications and ICT (Art. 54 and 78).
• Supreme Decree N° 3525 on Digital Signature.

Any dispute will be resolved by the courts of the city of La Paz.

11. Changes

We may modify these T&C when necessary, for example, to adapt to electoral regulatory or technological changes. Continued use of the App after the publication of changes implies acceptance by the user. Significant modifications will be notified through the application.
